Terms and Conditions

1. Scope of Services
Iron Peak Property Services LLC provides property maintenance and repair services as requested and approved by the client. All work performed will be limited to the scope outlined in the estimate, work order, or written approval.
Any additional work requested outside the original scope will require approval prior to completion and may result in additional charges.

2. Estimates and Approvals
All estimates are based on the information available at the time of inspection or request. If unforeseen conditions are discovered during the course of work, Iron Peak Property Services LLC will notify the client and provide an updated estimate if required.
Approval of an estimate or work order constitutes authorization to proceed and acceptance of these terms and conditions.

3. Not-To-Exceed (NTE) Authorization
Work may be performed up to any Not-To-Exceed (NTE) amount provided by the client without additional approval.
If, during the course of work, it is determined that the cost will exceed the approved NTE amount, Iron Peak Property Services LLC will pause work and notify the client. No additional work exceeding the approved amount will be completed without further authorization.
If no NTE amount is provided, Iron Peak Property Services LLC will obtain approval for any additional work outside the original scope or estimate.

4. Scheduling and Access
Clients are responsible for providing reasonable access to the property, including coordination with tenants when applicable.
If access is not available at the scheduled time, a trip charge of $125 may apply.

5. Authorization and Occupied Units
The client represents that they have the authority to approve work at the property.
Tenant coordination may be handled by either the client or Iron Peak Property Services LLC. When Iron Peak Property Services LLC coordinates directly, the client remains responsible for ensuring tenant contact information is accurate and that entry is authorized in accordance with lease terms and applicable laws.
When the client coordinates with the tenant, the client is responsible for confirming access, scheduling, and notice.
Iron Peak Property Services LLC is not responsible for denied access, tenant refusal, scheduling conflicts, or delays resulting from inaccurate information or lack of proper authorization for entry.

6. Photo Documentation
Iron Peak Property Services LLC may take photos before, during, and after service for documentation purposes, including condition verification and recordkeeping. These photos may be shared with the client as part of service updates.

7. Use of Media for Marketing
Iron Peak Property Services LLC may use non-identifiable photos and videos of completed work for marketing and portfolio purposes, including on its website and social media.
No personally identifiable information, tenant information, or property addresses will be disclosed without client consent.

8. Pricing and Payment Terms
Invoices are due upon receipt unless otherwise specified in writing on the invoice or work order.
Where different payment terms are stated on an invoice (e.g., Net 15 or Net 30), those terms shall govern for that invoice.
Late payments may be subject to a fee of 1.5% per month (or the maximum allowed by law), applied to the outstanding balance.
Iron Peak Property Services LLC reserves the right to suspend services on accounts with outstanding balances.
9. Minimum Service Charge
A minimum service charge of $125 applies to all standard service calls, regardless of scope or time on site. This covers travel, scheduling, and administrative costs.
After-hours, emergency, or expedited service requests may be subject to a higher minimum charge, which will be communicated at the time of scheduling or approval.

10. Materials and Fixtures
Materials provided will be standard-grade unless otherwise specified. If client-supplied materials are used, Iron Peak Property Services LLC is not responsible for defects, delays, or compatibility issues related to those materials.
11. Limitations and Exclusions
Iron Peak Property Services LLC does not perform work requiring specialized licensing unless explicitly stated.
The following are generally excluded unless specifically included in writing:

Structural modifications

Permitted work requiring inspections

Mold remediation or hazardous material removal

12. Workmanship
Iron Peak Property Services LLC will perform work in a professional and workmanlike manner. Any concerns regarding completed work must be reported within a reasonable timeframe.

13. Liability
Iron Peak Property Services LLC is not responsible for:

Pre-existing conditions or damage
-
Hidden issues not visible at the time of service
-
Consequential or incidental damages

14. Limitation of Liability
To the fullest extent permitted by law, Iron Peak Property Services LLC’s liability is limited to the amount paid for the services performed.
Iron Peak Property Services LLC shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of use, loss of rent, or property damage beyond the scope of the work performed.

15. Indemnification
The client agrees to indemnify and hold harmless Iron Peak Property Services LLC from any claims, damages, or expenses arising from:

Inaccurate or incomplete information provided by the client

Pre-existing conditions at the property
-
Tenant actions or failure to provide access

16. Tenant Interaction
When services are performed in occupied units, tenants are expected to provide reasonable access and maintain a safe working environment.
Iron Peak Property Services LLC will communicate respectfully with tenants but will not mediate disputes between tenants and property management.

17. Cancellations
Cancellations or rescheduling requests should be made with reasonable notice. Repeated cancellations may result in scheduling limitations or fees.

18. Warranty
A limited workmanship warranty may apply to certain services. Warranty coverage does not include:

Normal wear and tear
-
Misuse or neglect
-
Work altered by others after completion

19. Acceptance
By approving an estimate, work order, or service request, the client acknowledges and agrees to these Terms and Conditions.
